SAN DIEGO (AP) — The Marine Corps has ordered the release of a sergeant whose murder conviction in a major Iraq war crime case was overturned.
Marine Corps spokesman Lt. Col. Joseph Kloppel says Sgt. Lawrence Hutchins was ordered freed from the brig Friday.
A military court overturned Hutchins' conviction last month after determining his rights were violated when Navy investigators interrogated him in 2006 and held him in confinement with no access to a lawyer.
Hutchins led an eight-man squad that killed a retired policeman in the village of Hamdania. Hutchins says he believed the man was an insurgent.
Kloppel says Hutchins, of Plymouth, Mass., will be assigned to a base unit at Camp Pendleton, Calif.
The Navy is exploring its options and could appeal to the Supreme Court.
